Individuals who were granted conditional resident status through marriage to a U.S. Citizen or lawful permanent resident, may use form I-751 Petition to Remove the Conditions of Residence must be filed by the individual within 90 days of the green card's expiration date to avoid deportation. Once approved, the conditional status is removed, and a new Green Card, valid for 10 years, is issued
File Form I-751 as close to 90 days from your expiration date as possible. If you submit your form before the 90-day period, your application will be rejected. By submitting it too late, you risk missing your expiration date completely.
If you are still married, you may file Form I-751 concurrently with your U.S. citizen or permanent resident spouse . If you have dependent children who acquired conditional resident status on the same day as you or within 90 days thereafter, then include them on your form in order to request that the conditions of their status be removed as well. If you have dependent children who did not acquire conditional resident status on the same day as your or within 90 days thereafter, or if the conditonal resident parent is deceased, then those dependent children must file their own separate form I-751 Petition to Remove the Conditions of Residence remove their conditional status.
